Important: Ava Genesis is a technical deployment tool only. We are not a financial services provider, investment adviser, or broker-dealer. Tokens deployed through this platform are not vetted or endorsed by Ava Genesis. Do your own research before interacting with any token.
1. Acceptance of Terms
By accessing or using Ava Genesis ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Platform. These Terms apply to all visitors, users, and token creators.
2. Description of Service
Ava Genesis is a self-service, no-code platform that allows users to deploy ERC-20 token smart contracts on supported blockchain networks including Ethereum, Base, BNB Chain, and Polygon. The Platform provides tooling only — it does not operate, endorse, or take responsibility for any token deployed through it.
3. No Financial Advice
Nothing on this Platform constitutes financial, investment, legal, or tax advice. Token creation is a technical activity. Any decision to create, buy, sell, or hold tokens is solely your own. You should seek independent professional advice before making any financial decisions involving digital assets.
4. Risk Disclaimer
Blockchain and smart contract technology involves significant risk. Tokens may lose all value. Smart contracts, once deployed, are immutable and cannot be reversed. Network congestion, hacks, regulatory changes, and market conditions can result in total loss of funds. By using this Platform you acknowledge and accept all associated risks.
5. Platform Fees & Treasury Allocation
All fees are paid in cryptocurrency (ETH or USDC) directly on-chain. There is no free tier. Deployment fees by tier: Starter $10, Basic (burnable) $20, Premium (any advanced feature) $50. Gas fees are always extra and paid by the deployer to the network. On Starter tier only, 3% of the initial token supply is automatically minted to the Ava Genesis treasury wallet at deploy time — Basic and Premium creators receive 100% of their initial supply. All fees are non-refundable once a transaction is submitted to the blockchain.
6. User Responsibilities
You are solely responsible for: (a) all tokens you deploy and their compliance with applicable laws; (b) ensuring your token is not used for fraud, scams, rug pulls, or any other deceptive or harmful purpose; (c) disclosing the 3% platform allocation to your token holders; (d) complying with securities laws, anti-money-laundering regulations, and any other applicable regulation in your jurisdiction.
7. Prohibited Uses
You may not use the Platform to: deploy tokens intended to defraud investors; impersonate established projects or entities; create securities without proper registration; circumvent sanctions or facilitate money laundering; violate any applicable law or regulation. We reserve the right to blacklist wallet addresses that violate these terms.
8. Intellectual Property
The Ava Genesis brand, interface, and documentation are owned by Ava Genesis. Smart contract code is based on OpenZeppelin libraries and is open source. You retain no proprietary rights over the deployed contract code itself, but you retain ownership and control of your deployed token's treasury wallet.
9. Limitation of Liability
To the maximum extent permitted by law, Ava Genesis, its operators, contributors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of funds, loss of tokens, smart contract exploits, or regulatory action against your token. Your sole remedy for dissatisfaction with the Platform is to stop using it.
10. Indemnification
You agree to indemnify and hold harmless Ava Genesis and its operators from any claims, damages, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or any token you deploy that causes harm to third parties.
11. Modifications to Terms
We reserve the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the new Terms. We will note the revision date at the top of this page.
12. Governing Law
These Terms are governed by applicable international law. Any disputes shall be resolved through binding arbitration where permitted, or in a competent court of jurisdiction agreed by both parties.
